Everything you need to know about using the NexoPOS Platform responsibly and securely

Welcome to the NexoPOS Platform operated by Nexo Solutions LLC

These Terms of Service (“Terms”) govern your access to and use of the NexoPOS Platform, including all related services, applications, software, cloud infrastructure, downloadable tools, APIs, marketplace services, websites, and community features made available through my.nexopos.com.

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1. Definitions

For these Terms:

  • “Company” refers to Nexo Solutions LLC.
  • “Platform” refers to my.nexopos.com and all associated services and software.
  • “Services” refers collectively to the marketplace, cloud hosting, downloadable software, APIs, developer services, affiliate systems, user accounts, AI-powered features, and related functionality.
  • “User” refers to any individual or entity accessing the Platform.
  • “Author” refers to a user who publishes or sells modules, plugins, applications, themes, integrations, or other digital content on the Platform.
  • “Content” refers to files, software, text, images, comments, reviews, documentation, code, media, and uploads.
  • “Software” refers to NexoPOS, NexoPOS Cloud, NexoPOS for Windows, Nexo Print Server, modules, plugins, and downloadable applications.
  • “Subscription Services” refers to recurring billing services including hosting and cloud infrastructure offerings.

2. Eligibility

You must be at least 18 years old to use the Platform.

By using the Platform, you represent and warrant that:

  • You are legally capable of entering into binding agreements;
  • You are not prohibited from using the Services under applicable laws;
  • You are not located in a sanctioned or embargoed jurisdiction prohibited under United States law;
  • You will comply with all applicable local, national, and international laws.

3. Scope of Service

The Platform may include, without limitation:

  • NexoPOS marketplace services;
  • Cloud-hosted POS deployments;
  • Downloadable software and installers;
  • Module and extension marketplaces;
  • Affiliate and referral systems;
  • OAuth and API services;
  • Developer publishing tools;
  • Documentation systems;
  • AI-assisted services;
  • User-generated content systems;
  • Community reviews and comments;
  • Licensing and software delivery systems.

The Company may modify, suspend, discontinue, or replace any Service at any time without prior notice.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.

You agree that:

  • All information provided during registration must be accurate;
  • You are responsible for activities occurring under your account;
  • You will not share, sell, lease, or transfer your account;
  • You must immediately notify the Company of unauthorized account access.

The Company reserves the right to suspend or terminate accounts involved in:

  • Fraudulent activity;
  • Abuse of licenses;
  • Piracy;
  • Chargeback abuse;
  • Malware distribution;
  • Community harassment;
  • Unauthorized reselling;
  • Security violations;
  • Illegal activities.

5. Marketplace And Digital Products

5.1 Author Responsibility

Authors retain responsibility for:

  • The functionality of their modules or software;
  • Security practices within their code;
  • Legal compliance of distributed content;
  • Copyright ownership or authorization;
  • Maintenance and updates of their products.

The Company does not guarantee that marketplace products are error-free, secure, uninterrupted, or compatible with all environments.

5.2 Platform Moderation Rights

The Company reserves the right to:

  • Remove products;
  • Suspend authors;
  • Restrict visibility;
  • Remove reviews or content;
  • Disable downloads;
  • Revoke licenses;
  • Investigate security issues;
  • Reject submissions.

This may occur when content:

  • Violates laws;
  • Creates security risks;
  • Harms the community;
  • Contains malware or malicious code;
  • Violates intellectual property rights;
  • Misrepresents functionality.

6. Refund Policy

Digital purchases may be eligible for refunds within 30 days of purchase.

6. 1 Refund Eligibility

After you purchase an item, you may be eligible for a refund if, after you report an issue during business days, we fail to provide a proper solution within 3 business days.

Here is when refund can be requested:

  • The item doesn't work as described
  • The item contains malware or any resource that is likely to harm a server
  • The author is not willing to provide a fix to a security vulnerability
  • The item throws errors or works abnormally
  • The item is missing a feature stated on the description

When refund can't be requested:

  • The item is missing a feature not stated on the description
  • The customer changed his mind
  • The author doesn't want to provide installation service
  • The author doesn't want to edit the item to fit customer's needs

If you believe a case needs our attention, you can report an item and our team will investigate the situation.

6. 1 Refund Abuse

Refund eligibility may be denied in cases including but not limited to:

  • Fraudulent refund attempts;
  • Repeated refund abuse;
  • License misuse;
  • Unauthorized redistribution;
  • Excessive download activity suggesting abuse;
  • Violation of these Terms.

The Company reserves sole discretion regarding refund decisions.

For marketplace products sold by Authors, refunds may be processed by the Platform and deducted from future author payouts.

7. Subscription Services And Automatic Renewal

Certain Services may operate on recurring billing subscriptions.

By subscribing, you authorize the Company to automatically charge your payment method on a recurring basis until cancellation.

Subscription terms may include:

  • Monthly or annual billing;
  • Automatic renewal;
  • Usage-based pricing;
  • Hosting limitations;
  • Storage limits;
  • Bandwidth limits;
  • Fair usage enforcement.

Failure to pay may result in:

  • Service interruption;
  • Suspension;
  • Data deletion;
  • Loss of hosted environments.

8. NexoPOS Cloud Services

8.1 Service Availability

While the Company aims to provide reliable hosting services, uptime is not guaranteed.

Cloud services may experience:

  • Maintenance interruptions;
  • Network failures;
  • Third-party outages;
  • Infrastructure disruptions;
  • Security incidents;
  • Force majeure events.

The Company shall not be liable for losses resulting from service interruptions.

8.2 Customer Responsibility

Users remain responsible for:

  • Their business operations;
  • Data backups;
  • Regulatory compliance;
  • Tax reporting;
  • Data exports;
  • User permissions;
  • Operational continuity.
